Chapter I General Provisions Article 1 These Measures are formulated to strengthen the construction and management of urban road lighting facilities in this Municipality and to ensure the normal operation of urban road lighting facilities. In accordance with national laws, regulations and relevant regulations, and in conjunction with the actual conditions of this Municipality.
Article 2 The urban road lighting facilities referred to in these Measures refer to urban expressways, expressways, main roads, secondary trunk roads, bridges, tunnels, river embankments, pedestrian bridges, streets and residential quarters, industrial areas, parks and squares. Light poles and lamps in public places, as well as high- and low-voltage power distribution equipment, pipelines and wiring wells for powering road lighting.
Article 3 All units and individuals engaged in the planning, design, construction, maintenance and management of urban road lighting facilities and urban road lighting facilities within the urban area of ​​this Municipality shall abide by these Measures.
Article 4 The construction of urban road lighting facilities shall be invested by the government, or may be invested by units or individuals, and the principles of unified planning, unified standards, simultaneous construction, and standardized management shall be implemented.
Article 5 The Guangzhou Municipal Construction Committee (hereinafter referred to as the Municipal Construction Committee) is the competent department of the city's urban road lighting facilities, and is jointly responsible for the supervision and implementation of these Measures with the Guangzhou Electric Power Industry Bureau.
The Street Light Management Office of Guangzhou Electric Power Industry Bureau (hereinafter referred to as the Street Light Management Office) is responsible for the management of urban road lighting facilities in accordance with the authorization of these Measures.
Article 6 The departments of urban planning, municipal gardens, public security, industry and commerce shall implement these Measures in accordance with their respective functions.
The street office and the residents committee have the responsibility to assist in the safe maintenance of urban road lighting facilities.
Article 7 All units and individuals have the obligation to protect urban road lighting facilities and have the right to stop and report violations of these Measures.
Chapter II Planning and Construction Article 8 The planning and construction of urban road lighting facilities shall be incorporated into the urban road construction plan and implemented step by step according to the annual construction plan. The Municipal Construction Committee is responsible for formulating the development plan and annual construction plan for urban road lighting facilities, and the street lamp management office is responsible for the specific implementation.
Article 9 The urban road lighting facilities that need to be updated and rebuilt shall be responsible for the preparation of the annual renewal and transformation plan by the street lamp management office. After being approved by the Municipal Construction Committee, the street lamp management office shall be responsible for the specific implementation.
Article 10 Units that undertake the design and construction of urban road lighting projects shall be subject to review by the Street Light Management Office, obtain the design qualifications, construction qualifications approved by the construction administrative department, and the “Installation (Repair) Power Facilities License issued by the power management department). ", and only after obtaining a business license from the administrative department for industry and commerce, can proceed.
Article 11 The planning, design and construction of urban road lighting facilities shall implement the urban road lighting standards formulated by the state, and actively adopt new light sources, new technologies, new equipment and new technologies.
The planning and design of urban road lighting facilities should be coordinated with the urban landscape and the surrounding environment.
Article 12 Urban road lighting application shall be planned, designed, constructed and used simultaneously at the same time as the main project. The road lighting design plan must be reviewed by the street lamp management office before construction.
The electricity used for new road lighting facilities must be checked out by the street lamp management before being reported to the Power Supply department.
Article 13 The sections of the urban roads that cannot be separately set up with special lighting poles can be installed on the buildings or structures that meet the installation requirements of urban road lighting facilities. The ownership units and individuals of buildings or structures shall support and cooperate.
Article 14 After the completion of the urban road lighting facilities construction project, the Municipal Construction Committee shall organize or entrust the street lamp management office to organize the inspection and acceptance, and the experience shall be accepted before being delivered for use.
Chapter III Maintenance and Management Article 15 The Municipal Construction Committee and the Guangzhou Electric Power Industry Bureau shall strengthen the supervision and management of the street lamp management office. The street lamp management office shall establish an inspection and assessment system, and shall maintain and manage the city road lighting facilities in accordance with the following requirements.
(1) Maintaining the normal operation of road lighting facilities and ensuring a lighting rate of over 95%.
(2) The road lighting facilities are faulty and are subject to repairs within 24 hours. The general faults shall be dealt with in a timely manner. In addition to the cause of force majeure, serious faults shall be processed within 5 working days.
(3) Promote and adopt high-efficiency energy-saving appliances to improve road lighting effects.
(4) Establish and improve technical materials and archives related to road lighting, and gradually implement modernization, scientificization and automation of operation management and data management.
(5) Completing other work of maintenance and management of road lighting facilities entrusted by the competent department.
Article 16 The urban road lighting facilities invested by units or individuals shall be maintained and managed in accordance with the requirements of Article 15 of these Measures, and shall be subject to the supervision, inspection and guidance of the Municipal Construction Committee and the Street Lamp Management Office.
Article 17 If urban road lighting facilities invested by units or individuals are to be handed over to the street lamp management office for maintenance and management, the following conditions shall be met:
(1) Comply with the quality standards for road lighting design, installation and construction.
(2) Providing necessary maintenance conditions, such as complete papers and smooth roads.
(3) Paying the operation and maintenance expenses for 3 years at one time.
If the above conditions are met, the approval of the Municipal Construction Committee shall be carried out by the street lamp management organization for inspection and acceptance, and the transfer procedures may be completed after passing the examination.
Article 18 If municipal construction, residential quarters and other construction projects need to be demolished or reconstructed, thus hindering the normal operation of road lighting facilities, the construction unit shall submit a report to the street lamp management office 15 days in advance, and entrust the street lamp management office to adopt migration, protection and establishment. Temporary street lights and other necessary measures can be started. When the project is completed, road lighting facilities or new road lighting facilities should be restored at the same time. The necessary costs are borne by the construction unit.
Due to the disaster caused by the rescue and disaster relief to the urban road lighting facilities, the emergency rescue unit should promptly notify the street lamp management office.
Article 19 Any tree that affects the safety of road lighting facilities and the effect of road lighting shall be pruned when the opinions submitted by the street lamp management office are submitted to the landscaping department; the trees shall endanger the safety of road lighting facilities due to force majeure such as typhoons, heavy rains and sudden accidents. The landscaping department shall take urgent measures to pruning and felling.
Article 20 No unit or individual may have any behavior that jeopardizes road lighting facilities:
(1) arbitrarily occupying, demolishing, relocating or modifying road lighting facilities;
(2) Unauthorized operation of road lighting switch facilities;
(3) erecting pipelines or installing other facilities on road lighting facilities without authorization;
(4) posting or hanging advertisements, signs, and slogans on road lighting facilities without authorization;
(5) stacking materials and hanging items on road lighting facilities;
(6) shooting or throwing objects at road lighting facilities;
(7) arbitrarily connecting road lighting power sources;
(8) Destroying and stealing road lighting facilities;
(9) Other acts that endanger road lighting facilities.
Article 21 A major celebration event shall be held. With the approval of the municipal government, a publicity slogan or a light scene may be set on the streetlight pole of the designated section. After the activity is over, the relevant units shall promptly dismantle and clean up and restore the original status of the lamppost.
Article 22 The funds required for the daily operation and maintenance management of urban road lighting facilities shall be included in the urban facility maintenance fee plan, earmarked for special purposes, and subject to the supervision of the financial and auditing departments.
Chapter IV Legal Responsibilities Article 23 Anyone who commits one of the following acts in violation of these Measures shall be punished by the Municipal Construction Committee or the street lamp management office entrusted by him:
(1) In case of violation of item (1) of Article 20 of these Measures, it shall be ordered to restore the original condition and compensate for the loss, and shall impose a fine of 200 yuan or more and 1,000 yuan or less for the responsible person and 2,000 yuan or more and 10,000 yuan or less for the unit.
(2) In case of violation of item (2) of Article 20 of these Measures, the person responsible shall be fined between 100 yuan and 500 yuan; if the loss is caused, the person shall be ordered to compensate for the loss.
(3) Anyone who violates items (3), (4) and (5) of Article 20 of these Measures shall be ordered to return to the original condition, and the person responsible shall be fined not less than 1,000 yuan but not more than 5,000 yuan.
(4) In case of violation of items (6), (7), (8) and (9) of Article 20 of these Measures, the responsibility shall be to stop the illegal act and compensate the loss, and impose a fine of not less than 500 yuan but not more than 1,000 yuan on the responsible person. .
(5) The road lighting design plan has not been audited by the street lamp management office, the road lighting telegraph installation has not been noticed by the street lamp management, or there is no urban road lighting engineering design and construction qualification, and the road lighting design, construction or road lighting project is completed without authorization. Those who have not experienced the use of income from their own income shall be ordered to make corrections within a time limit, and the person responsible shall be fined not less than 500 yuan and not more than 3,000 yuan, and the unit shall be fined not less than 2,000 yuan and not more than 10,000 yuan.
(6) For the road lighting facilities invested by the unit or individual, if the owner fails to perform the duties of maintenance and management, he shall be given a warning and ordered to make corrections within a time limit. If the owner fails to make corrections within the time limit, he shall be fined 500 yuan to 1,000 yuan for the owner. .
Article 24 Anyone who violates these Measures and involves other administrative regulations shall be dealt with by the corresponding competent department according to law; if the Regulations of the People's Republic of China on Public Security Administration Punishment are violated, the public security department shall impose punishment according to law; if the criminal law is violated, the judicial organ shall Criminal responsibility shall be investigated according to law.
Article 25 If the road lighting management department and its staff members have serious social impacts due to negligence and malpractices, the unit or the competent department at the higher level shall give administrative sanctions; if the criminal law is violated, the judicial organs shall pursue criminal responsibility according to law.
Chapter V Supplementary Provisions Article 26 The management of the construction of urban road lighting facilities in county-level cities may be implemented with reference to these Measures.
Article 27 These Measures shall come into force on September 1, 1998.
